Privacy Policy - Epique Studio

Epique Studio places at the heart of its mission, its commitment to transparency regarding the Data collected about the User of the Site, their use and the entities with which it shares them and this, in accordance with the Regulation of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (Hereinafter referred to as " RGPD "). 

To this end, Epique Studio has established a privacy policy (hereinafter referred to as the " Privacy Policy ") that applies whenever User Data is collected to identify the User and after the User has agreed to it. 

Epique Studio collects User Data when the User performs any of the following actions on the Site: 

  • A request for contact and information
  • A subscription to the newsletter 
  • And any section in which the User is asked for Data

1. Definitions

Hereinafter referred to as " Site ": all products and services offered by Epique Studio on the Internet from the address

Hereinafter referred to as " User ": any natural person who accesses the Site, regardless of where they are and how they connect to the Site. 

Hereinafter referred to as " Epique Studio ": the holder of all rights (including those relating to intellectual property) of the Site and making the Site available to the User.

Hereinafter referred to as " Services ": all the functionalities offered by the Site. 

Hereinafter referred to as " Data ": information relating to a natural person identified, directly or indirectly, by elements that are specific to him. 

2. Person in charge of the treatment

The person in charge of processing is Epique Studio, with the SIRET number 894 285 295 00016, designated the " Company ", located at Le Puy du Fou, 85590 LES EPESSES and represented by Mr Augustin de Belloy, General Manager. 

As a User of the Site Services, the collection, use and sharing of Site Data is subject to this Privacy Policy and any updated versions thereof. 

This Privacy Policy is subject to change and if the changes are material, the User will be notified via the Services or other means. The purpose is to give the User the opportunity to review the changes before they take effect. If the User objects to any of the changes, he or she may notify the data controller directly. 

The User acknowledges that continued use of the Site Services following the posting of changes to the Privacy Policy or the provision of notice of such changes means that the collection, use and sharing of the User's Data is subject to the updated version of the Privacy Policy. 

3. Data collected

Epique Studio attaches great importance to the protection and respect of the User's Data and therefore to his privacy. 

The User will find in this Privacy Policy details of the Data processed and the purpose of such processing. 

  1. Data that the User provides 

The Data collected are collected through forms and through the interactivity established between the User and the Site. 

The type of Data that the User will be asked to provide are the following:

  • First name
  • Name
  • Email address 
  • Phone number
  • Role(proposals)
  • Message(free field)

Epique Studio will ensure that the collection of User Data is relevant, adequate, not excessive and strictly necessary for the activities of the Site. 

The User is informed that certain information is essential to benefit from the Site's Services. Indeed, when he fills in a collection form, the compulsory Data are indicated by an asterisk. If they are not provided, the User will not be able to benefit from the Services concerned. 

  1. Evolution of the Data collected

As the Services on the Site are dynamic, new features may be offered that require the collection of new Data. If Data of a substantially different nature is collected or if the use of the User's Data is substantially modified, the User will be informed and the Privacy Policy will be modified. 

4. Use of collected data

User Data is held to provide and customize the Site's Services so that they are more relevant and useful to the User.

User Data is collected to:

  • To allow navigation on the Site and management
  • Prevent and fight against computer fraud (spamming, hacking...): computer equipment used for navigation, IP address
  • Improve navigation on the Site 
  • Conducting voluntary satisfaction surveys 
  • Conduct communication campaigns (sms, email): phone number, email address

The User Data is not commercialized but only used by necessity or for statistical and analysis purposes. 

Epique Studio only collects and processes User Data for which it has a legal basis. These include the User's consent where given.

Where the processing of User Data is subject to consent, the User has the right not to consent or to withdraw consent at any time. 

If the User has any questions regarding the GDPR on which Epique Studio relies for the collection and use of Data, he/she should contact the Data Protection Officer whose contact is indicated in Article VIII below.

  1. Development of Services

User Data is used to conduct research and development activities related to the Site Services in order to provide a better, more intuitive and personalized experience for the User and other users.

  1. Security and investigation 

User Data may be used, if necessary for security purposes or to investigate suspected fraud and other violations of the Terms and Conditions or this Privacy Policy and/or attempts to cause harm to any other User. 

5. Cookies

A cookie is a small information file sent to the User's browser and stored within the User's terminal (e.g. computer, smartphone), (hereinafter " Cookies "). This file includes information such as the User's domain name, the User's Internet service provider, the User's operating system, and the date and time of access. Cookies will not damage the User's terminal in any way.

Epique Studio is likely to process the User's information concerning his visit to the Site, such as the pages consulted, the searches made. This information allows Epique Studio to improve the content of the Site and the User's navigation.

Since Cookies facilitate browsing and/or the provision of the Services offered by the Site, the User may configure his browser to decide whether or not to accept them, so that Cookies are recorded in the terminal or, on the contrary, that they are rejected, either systematically or according to their sender. The User can also configure his navigation software so that the acceptance or refusal of Cookies is proposed punctually, before a Cookie is likely to be recorded in his terminal. Epique Studio informs the User that, in this case, it is possible that the functionalities of his navigation software will not be available.

If the User refuses the recording of Cookies in his terminal or his browser, or if the User deletes those recorded there, the User is informed that his navigation and experience on the Site may be limited. This could also be the case when Epique Studio or one of its service providers cannot recognize, for technical compatibility purposes, the type of browser used by the terminal, the language and display settings or the country from which the terminal seems to be connected to the Internet.

If necessary, Epique Studio declines any responsibility for the consequences related to the degraded functioning of the Site and the Services possibly proposed by Epique Studio, resulting from :

  1. the refusal of Cookies by the User
  2. The impossibility for Epique Studio to record or consult the Cookies necessary for their operation due to the User's choice. 

For the management of Cookies and the User's choices, the configuration of each browser is different. It is described in the browser's help menu, which will show how the User can modify his or her wishes regarding Cookies.

At any time, the User can choose to express and modify his wishes regarding Cookies. Epique Studio may also use the services of external service providers to help it collect and process the information described in this section.

Finally, by clicking on the icons dedicated to the social networks Twitter, Facebook, LinkedIn and Google Plus appearing on the Site and if the User has accepted the deposit of Cookies by continuing to browse the Site, Twitter, Facebook, LinkedIn and Google Plus may also deposit Cookies on their terminals (computer, tablet, mobile phone).

These types of Cookies are only deposited on the User's terminals if he/she consents to them, by continuing his/her navigation on the Site. At any time, the User may nevertheless revoke his consent to Epique Studio depositing this type of cookie.

6. Sharing your information

  1. The Services

Only the data controller and the recipients will have full access to the User's Data in accordance with the above provisions. 

User Data may be shared in connection with, or in preparation for, a sale, merger or takeover of the Company. Any third party entity that acquires all or part of the Company will be permitted to use User Data only in accordance with this Privacy Policy. 

  1. Subcontractors 

Epique Studio uses subcontractors to provide the Site Services (e.g., for hosting, maintenance, malware and virus detection, Site development). They have access to User Data to the extent necessary to perform these tasks on behalf of the Company and are required not to disclose or use it for any other purpose. 

Authorized Subcontractors are : 

  • GRAND PARC DU PUY DU FOU, a simplified joint stock company with a capital of €50,000,000, whose registered office is located at lieudit Puy du Fou, 85590 LES EPESSES, registered in the LA ROCHE-SUR-YON Trade and Companies Register under number 347 490 070
  • T-H-I-R-D, a simplified joint stock company with a capital of 50,000 euros, whose registered office is located at 8 rue Lépine, 93500 Pantin, registered in the BOBIGNY Trade and Companies Register under number 788 767 226
  • PUY DU FOU INTERNATIONAL, a one-person simplified joint stock company with a capital of 10,000,000 euros, whose registered office is located at Puy du Fou 85590 Les Epesses, registered in the LA ROCHE-SUR-YON Trade and Companies Register under number 519 657 639 

  1. Legal disclosure to authorized third parties 

The Company may be required to disclose User information when required to do so by law, court order or other legal process, or if the Company believes in good faith that such disclosure is reasonably necessary to: 

  • Investigate, prevent, take action against, or assist judicial institutions in the investigation of known or suspected illegal activities
  • Respect the contracts signed with the User 
  • Guarantee the security or completeness of the Services
  • Exercise or protect the rights and safety of Société Epique Studio, the User, staff or third parties 

If Epique Studio deems it appropriate, it will endeavor to notify the User who is the subject of a lawful request for disclosure of his or her Data, except in cases of emergency or if prohibited by law or court order. 

Epique Studio may challenge such requests where it believes they are excessive, vague, or not properly authorized, without committing to challenge all such requests. 

  1. Unauthorized third parties 

The User Data is only intended for the Company and is only accessible by those persons authorized to manage it, according to the purposes of collection and within the limits of their respective attributions as previously stated. 

This Data will not be visible to unauthorized Users or third parties.

7. User rights

In accordance with the laws and regulations relating to the protection of personal data in force, the User has a right :

ACCESS: the right to obtain confirmation as to whether or not your Data is being processed and to obtain a copy of your Data

OF RECTIFICATION: the right to obtain, as soon as possible, the rectification of its Data in case of inaccuracy 

TO DELETION: the right to obtain the deletion, as soon as possible, of his Data when one of the reasons referred to in Article 17 of the GDPR applies. Under this Privacy Policy, the deletion of the User's Data may take between one and three months depending on the complexity of the request. 

TO LIMITATION OF PROCESSING: the right to obtain from the Company that it does not process your Data for a specified period of time according to the reason invoked for the limitation as referred to in Article 18 of the GDPR.

TO DATA PORTABILITY: the right to receive one's Data in a structured, commonly used and machine-readable format as well as the right to transmit one's Data to another data controller 

OPPOSITION: the right to request that the Company no longer processes his/her Data for a reason related to his/her particular situation or without a reason in case of commercial prospecting 

WITHDRAWAL OF CONSENT: the right to withdraw consent to the processing of your Data by the Company at any time.

8. Shelf life

The Company keeps the User's Data from the last collection and in accordance with the legal periods provided. 

The aforementioned rules apply to the Data that the User has provided in accordance with Article III/a of this Privacy Policy.

9. Transfer of data outside the European Union

The User's Data is processed in compliance with European and French regulations on personal data and in particular the General Regulation for the protection of personal data (RGPD) n°2016/679 of the European Parliament and of the Council of 27 April 2016 and the law n°78-17 of 6 January 1978 known as "Informatique et Liberté" in its latest version. 

In this context, the recipients of the Data that the company may collect may be located abroad, including outside the European Economic Area (hereinafter referred to as the " EEA ") in countries where personal data protection legislation differs from that applicable within the EEA. 

Any transfer of data outside the EEA shall be made subject to appropriate safeguards, including contractual safeguards, in accordance with applicable data protection regulations. 

10. Security measures

The Data that the Company collects is kept in a secure environment. The persons working for the Company are required to respect the confidentiality of this Data. 

The Company is committed to maintaining a high degree of confidentiality by incorporating the latest technological innovations to ensure the confidentiality of Data transactions. 

However, since no mechanism offers maximum security, there is always a degree of risk involved when the User uses the Internet to transmit Data. If this should happen, the Company undertakes to implement measures to stop the breach as soon as possible. 

11. Update of the privacy policy

This Privacy Policy may change periodically. The Company will inform the User of any substantial updates and invites the User to consult it regularly.
